Hammerhead's ADLY Vehicles Warranty
Steele’s Powersports, ("Dealer") warrants its parts ("ADLY Scooters") against all defects in materials and workmanship for 2 years, (730 days) on defective parts and 2 years (730 days) on labor, from the date of purchase subject only to the following conditions and exclusions:
This Limited Warranty applies only to:
A. The original purchaser and shall not apply to any subsequent owner, assignee, or other recipient of the buggy from the original purchaser.
B. The warranty is effective as listed below OR 20,000 kilometers (whichever comes first) from the date of purchase by the original owner.
- All parts are covered for 365 days
- Engine and electrical for 540 days
- Engine for 730 days
C. Vehicles purchased:
- Directly from a Steele’s Powersports location or;
- From a Hammerhead / ADLY authorized dealer thereof.
D. Steele’s Powersports will not cover parts, (or reserve the right to at our discretion) that have:
- Any damage resulting from negligence of the periodic maintenance.
- Any damage which results from repair adjustment or maintenance operations by any methods other than those specified by ADLY.
- Any damage which results from hard driving due to a race, rally, or operation in a location not generally used for driving.
- Any damage which results from use beyond the limitations specified in the ADLY Operations Manual, such as overloading the vehicle or any damage from the use under abnormal conditions.
- Any damage caused when the product is used as a rental vehicle.
- Any damage which results from use of non-genuine parts or accessories or fuel, lubricant or fluid not specified by ADLY.
- Any damage which results from modifications of the product.
- Any damage which results from the passage of time (natural fading of painted surfaces, plated surfaces, sheet peeling and other deterioration).
- Consumable replacement parts--ADLY will not warrant parts worn due to natural wear and tear such as spark plugs, drive chains, air cleaners elements, brake shoes, clutch disks, light bulbs, batteries, fuses, rubber parts (such as tubes & tires), oils and cables.
- Any damage due to improper use, storage or transport.
- Any damage which results from repair, adjustment or maintenance operations performed by any person other than a Hammerhead Off-Road dealer.
- Any damage which results from unavoidable natural disasters, fire, collision, theft, and second damages based on any of these occurrences.
- Incidental or additional expenses incurred for making any claims such as those for towing, communications, hotels and meals, as well as any losses during maintenance period, such as loss of time, loss of business and rental car expenses.
- Scheduled maintenance and inspection fees.
Any claim against this Limited Warranty shall in no way be construed as extending warranty coverage beyond the original period that commenced upon date of purchase.
- Purchaser holds the Dealer harmless for any consequent injury, loss, or damage resulting from:
A. Defect or malfunction of the Product;
B. Acts of God;
C. Purchaser misuse, unreasonable use, tampering, abuse, acts of omission, failures to exercise due diligence, or negligence;
D. Alterations to the Product by any person or entity other than Steele’s Powersports or an Authorized Hammerhead dealer.
IMPORTANT: All scooters MUST BE INSPECTED by an authorized Hammerhead Off-Road dealer within 90 days from the date of purchase or the Hammerhead Off-Road limited warranty will be null and void. You are required to maintain a record of the initial inspection which will be required upon your application for any benefits covered by the Hammerhead Off-Road Limited Warranty.
- These warranties set forth herein are in lieu of any and all other warranties, expressed or implied, including the warranties of merchantability or fitness for specific purpose.
- Purchaser represents and agrees that any claims which it may assert against Dealer shall be limited to those which may be asserted under the foregoing limited warranty.
- This warranty is offered exclusively by Steele’s Powersports. By making a purchase with our company, Purchaser agrees that he/she has read, accepts, and agrees to this Limited Warranty and its terms.
